WE, AT BUZZY SMART BAND LTD. ("WE"), TAKE YOUR PRIVACY SERIOUSLY. WE RESPECT AND PROTECT THE PRIVACY OF OUR USERS AND TAKE APPROPRIATE STEPS TO SAFEGUARD THEIR PERSONAL INFORMATION. THIS PRIVACY POLICY (THE “POLICY”) EXPLAINS THE TYPES OF INFORMATION AND DATA THAT WE RECEIVE, COLLECT CREATE AND PROCESS WHEN YOU USE OUR APPLICATION AND THE RELATED SERVICES OFFERED BY US AS PART OF THE APPLICATION (THE "SERVICES") AND DESCRIBE THE WAYS WE USE AND PROTECT THEM. ALL TERMS NOT DEFINED HEREIN IN SPECIFIC, SHALL HAVE THE MEANING ASCRIBED TO THEM IN THE TERMS OF USE THE USE OF THE APPLICATION AND/OR ANY OF THE SERVICES IS SUBJECT TO THE PROVISIONS OF THIS POLICY. THIS POLICY MAY BE UPDATED FROM TIME TO TIME, THEREFORE WE ASK YOU TO CHECK BACK PERIODICALLY FOR THE MOST UPDATED POLICY, AS INDICATED BELOW. YOUR USE IN THE APPLICATION AND/OR YOUR USE OF ANY OF OUR SERVICES, AFTER THIS POLICY HAS BEEN AMENDED, SHALL BE DEEMED TO BE YOUR CONTINUED ACCEPTANCE OF THE TERMS OF
THIS POLICY, AS AMENDED.
Information we collect
Our primary goal in collecting personal information is to provide You, the user of the Application, with a customized and efficient experience, and therefore We only collect personal information that is relevant for such purpose. Personal Information means information that identifies or could be used to identify an individual, directly or indirectly. We collect the following types of information from our users:
1. Registration Data. As a condition for the use of the Application, and engaging with us, you will be required to provide us with the following information (the "Registration Data"): (i) If you are a patient (either private or via medical institution), You will be required to provide certain information concerning You by way of filling in a short anonymous health questioner. (ii) If you are a private patient You will also be required to provide us with the following identifiable information that will be considered as Registration Data such as your name, email address, and account credentials, or you may choose to register using your Google or Facebook account., however if you are a patient of a medical institution, please be advised that you will not be required to provide any information that may identify you. (iii) If you are a doctor, in order to receive approval for using the dashboard that contain the details of your patients, You will be required to provide certain identifiable information such as your name, professional affiliation, and email address. (iv) If you are a relative invited by a patient to access certain information through the Application, You will be required to provide your email address and basic identification details in order to verify your access and confirm that your email address matches the one provided by the patient. You may review and edit your Registration Data by using your login details (username and Password).
2. Automatic Tracking. By the nature of its functionality, the Application will be able to, and may track certain information about You, in order to perform internal research on our users' demographics, interests, site usage patterns and behavior. This information is collected in an aggregate form, without usually identifying any user individually, except with respect to user IP Address that is considered as personal information. Non- personally identifiable information may be analyzed by us for the purpose of improving and expanding the functionality of our Services as well as to improve the Application.
3. Collected and Processed Information. As part of using the Application, we may ask you to provide certain additional Information concerning you such as survey responses, self-reported wellbeing information, and other inputs that you may choose to submit through the Application (the "Uploaded Materials"). Processed Information. as part of your use in the Application, subject to your consent, the Application may collect certain information and parameters concerning You via your smartwatch (either your own smartwatch or the one We provide you) such as heart rate, HRV (heart rate variability), sleep patterns, physical activity, stress-related indicators, and other physiological signals, and shall provide analysis, summaries, recommendations and inputs concerning them ("Processed Data") Registration data, Automatic Tracking, Uploaded Materials and Processed shall be referred to as "Collected Data") The Collected Data may be viewed by You at all times. You shall have the option to give permission for your relative and/or your doctor to view all or part of your Collected Data by providing their email address, after which we will send them an invitation to access the relevant information. We do not oblige you to provide us any type of information or data, and uploading or analyzing the Collected Data is at your sole discretion, and is not a condition for using the Application, and therefore You may choose not to provide all or part of the Collected Data and/or to define the Application not to collect certain Collected Data or not to make certain process to the materials however by doing so, we may not be able to provide you with the full scope of our services. Please do not upload any data or information that is not owned by you or that you didn’t receive the approval by its owner to provide it. We will not sell, trade or rent any Collected Data related to you to others, except as specified in this Policy. Any Collected Data will be owned by You and licensed to the Company for use by the Company in accordance with this Privacy Policy. Collected Data that we collect shall be saved and stored at the following databases and platforms: Amazon Cloud services (AWS) under the Company's registered database, that
will be controlled by the Company.
Cookies
Cookies are very small text files that are stored on your computer when You visit certain websites and can store information about your use of the Application. We use a combination of few types of cookies such as session cookies and persistent cookies, in order to track, how You use and experience the Application, build anonymous statistical data about how the Application is performing, to make the Services more customized and to inform us of a repeat visit without knowing who a visitor is or its personal information. Please ensure that other third parties that provided such information are aware of such fact.
Usage Of Collected Data
a. Internal Use. We use the Collected Data for internal purposes, to improve theApplication and the Services we provide, and to better tailor them to meet your needs.In addition, We use the Collected Data to analyze usage, and to deliver Youinformation about certain promotions, services or items that might interest You. Wemay use Your e-mail address to contact You from time to time, in order to notify Youabout new services and updates. If You do not wish to receive such mailings, simplynotify us in email to: support@buzzyplatform.com
b. Improving the Application. We will use the Collected Data to improve the use andtroubleshoot problems, bugs and errors in the Application.
c. Advertising. We may advertise and promote the Application or any of the Servicesand its contents, however, We will not disclose, sell or transfer any Collected Data(other than automatic tracking) to any third parties for the purpose of advertising orpromotion (e.g., advertisers or business partners), except as specified in this Policy.
d. Third Parties. We may at any time add affiliate partners such as clinics, organizations,associations and hospitals or 3 rd party providers to our Application, but the sharing ofinformation with them will be limited to only unidentified information.
e. You hereby consent to permit us, to process and transfer the Collected Data, asnecessary for us to provide You with our Services.
f. Special Cases. We may disclose Collected Data collected, in special cases when wewere ordered to do so by a judicial authority, to respond to subpoenas, court ordersand law enforcement or government request or when we have reason to believe thatdisclosing such Collected Data is necessary to identify, contact or bring legal actionagainst someone who may be violating this Policy or may be causing injury to orinterference with (either intentionally or unintentionally), our rights or property, otherusers, or anyone else that could be harmed by such activities.
g. We may disclose Collected Data as part of a process of due diligence for investmentof M&A transaction as well as to our service providers such as accountants and/orlegal advisors as well as third party storage entities.
h. We shall disclose all types of Collected Data concerning You to the doctor or relativethat will be chosen by you in the Application for the purpose of providing You withthe Services of the Application.
Protection of Information
Collected Data is encrypted and protected by firewall and by Secure Sockets Layer (SSL), the industry standard, for encrypting all personal information. Although, We use industry standard practices to protect your privacy, We do not guarantee, and You should not expect that Collected Data collected will always remain completely private. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform specific work are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.
Disclosure Information in the Event of a Merger
We may merge or be acquired by another business entity or may sell all or substantially all of our assets to an acquirer. In the event of such merger, acquisition or sale, We may share some or all of your Collected Data with the acquiring company in order to continue serving You the Services. In such event and if applicable, We will provide notice that such information is transferred and may become subject to a different privacy policy.
Your right of Deletion, limitation or to be forgotten
You may request the deletion of any and all Collected Data that we have collected ands aved with respect to You, at any time and request that we cease further dissemination ofthe data and have third parties cease processing of the data by submitting a request to Company's DPO. You shall have the right, at any time, to request to limit the Collected Data that You wishto be saved or processed, and Company shall comply with your request.
Be aware that requesting total deletion of all your Collected Data, unlike unsubscribing, is total and irreversible. This means that we will also lose record of You having ever been on our systems. If You choose in the future to open a new account, You will appear to us as completely new customer.
To request deletion, limitation or amendment of your Collected Data, contact Company'sDPO indicating your full name identified in your Account and your detailed request and we shall promptly respond to it.
We may save part of the Collected Data that: (i) we are permitted to save by law (ii) is saved as automatic backup at our servers (iii) we are required to save for internal use.
Governing Law; Jurisdiction
This Privacy Policy shall be construed and governed under and by the laws of the State ofIsrael. The parties agree that exclusive venue for any legal action relating hereto shall bein the courts of Tel Aviv - Jaffa. The parties agree not to contest the venue set forthherein and to submit to, and not contest, the exercise of personal jurisdiction over themby any of the foregoing courts.
